In my opinion if he is 38 inches he is not a pony but perhaps a mini.
your weight is too much for him, just find a confident younger rider,about 60 -70 lbs, and after he is accustomed to a salddle than keep him on a lead line with the child. Treat and train just like a big horse but smallerl

I have quite a few registered American Shetland Ponies that measure 38 and some even under
I do think 115 lbs is too much especially when you add in weight for the saddle. A 115lb adult really needs the larger size pony around 44-46" Many ponies are broke to ride by first getting them used to the bit and saddle by line driving them on long lines. Then you can add weight to the saddle. You could always get on for just a few minutes to make sure there is no buck etc.
