What do you do? *update*

When someone that has your horse becomes unresponsive. When they dont answer any emails, messages or voicemails regarding your horse?

It is hard to understand without some details.

First, what are the conditions of their possession of the horse? Was there a contract?

Do you hold the papers on the horse?

How far away is the horse?

My first option would be to do a driveby. Stop by and say hey, checking on you guys, bring them an apple pie or whatever to check up and make sure people and horse are safe. The second option would be get a lawyer or authorities involved.

I would at the very least go to wehere they are and check up on the horse.
from there depends on the details.. if you are selling the horse and they are not making the payments.. go get it..
if it's a lease, unless your contract says they have to stay in touch, as long as they are caring for the horse, you may just have to talk to them in person and explain to them that you would like for them to maintain communication.

Can you give us more deatils?

It was a "lease-type". But unfortunately for me, no contract. It was between me and a friend. The "lease", at least what I thought was understood between us wasnt necessarily set for a specific amount of time but I ALWAYS said the horse was to be brought back to me if necessary, whatever the case may be.

Do you hold the papers on the horse?
All paperwork is in my name and possession, there is no "lease" filed with the breed association as the horse wasnt really going to be used for much of anything that required it (ie breeding or show).

How far away is the horse?
The last known address of the horse's location was approximately 1.5hrs+ away. But I know the horse was moved to another location (I know the exact place), then picked back up and moved again but Im unclear as to whether the horse was brought back to the original location or another. Another detail Ive been trying to find out through me contacting my friend.

I dont want to give away too many details as Im not sure whats going on myself. Im just extremely worried about it.

I know for some time I wasnt able to talk to my friend as I had lost my job, moved from one place to another and lost her phone number at one point. But I did email/message without getting a response back on numerous occasions. I eventually did find my friend's number and tried to call but didnt get an answer. I left message and never heard back.

I want to bring my horse back home, period end of story. This is why Im trying to get a hold of my friend in the first place. Ive been living in GA and just moved back here after bouncing around up there.

Oh man,
This is a tough one...
I would say do what ever you can to find him... Is he microshipped? I am not very clear on the microchip, but can't you track your horse if he has one?

I'm so sorry that you are in this situation.

Since you still have ownership, you can take back possession of the horse any time and you should. With no way to check up on the horse, it is a huge liability for yourself to not know.

Send a certified letter stating the action that you will take if she does not contact you. If she doesn't respond that that you have very right to get the authorities involved.

That is really hard. Def Def should ALWAYS write a contract...they may be your friends...but friends can def screw ya over. Im sorry...this would be very hard.
I would def drive by his last known place and just see if anyone is there and ask around to the neighbors(or the current people living there) about your horses where abouts. Keep trying the phone...does it go to the right voicemail even? Do you know any of your *friends* friends that might know where he/she is??? Microchipped? Check around with local vets maybe they have seen the horse and have the newest address? Just some ideas

I know I should have had a contract, I mean I ALWAYS did contracts before. I dont know why I didnt this time.

I just sent a message to a mutual friend and hopefully maybe they know something I dont. When I would call my friend it would just ring, ring, ring and then go to voicemail.

My horse is not microchipped.

Oh my gosh! What a worrying situation. I agree with what everyone else has advised you to do. And since you have retained ownership and all registration papers are currently held by you and in your name, I really feel like you have every legal right to bring your horse back home any time you want to. The scary and worrying part about all of this is that you have lost contact with the people who have him, and are now unaware of his location. I really hope you can get him back...and soon. Please keep us posted.

I managed to track down the lady that took in my older companion mare that I had given to this person who was leasing my QH mare. My old mare was left abandoned at a barn starving and in poor shape. But Im glad to share that she is all better now and doing extremely well. The lady I spoke with though was so nervous that I was going to come take her back but I told her that as long as she is happy, I am happy. I have plans to visit. As soon as I get new pictures of her I will share.

However as good of news that is, there is bad to follow. I still cannot track down my QH mare. Today I made an official report with the authorities. I have been trying for months and I dont think that there is much else I can do. So maybe the authorities will be able to turn something up that I couldnt. I really hate to involve them, but at this point I feel like I have no other choice.

Whatever was going on with "my friend" I dont know but she ought to be really ashamed of herself for letting what happened to my old mare and my QH mare happen. I really hope she feels awful about it because I am sick to my stomach over it.

Don't beat yourself up over it - it could happen to anyone. I am glad that you took some affirimitve action and called the authorities. And it is also good to hear news on your other mare - better to know then be left wondering.

It sounds to me that your"friend" knows your phone number and will not answer it because she dose'nt want to speak with you. Try using a different phone, maybe borrow a friends phone that she will not regonize(sp). I wish you the best of luck.

I have tried. She does not answer anytime I have called. Ive called off of completely different area codes too as I have been trying to contact her since before I moved back from GA. I had a new cell phone number, tried calling her off of that numerous times- no answer. Now Im calling off of a different number, nothing. She just will not answer/return my phone calls.

I had another lady I met (after posting about my mare on another forum) that is friends with the girl that is supposed to have my mare. She emailed her about my QH and got a response back. However, any attempts I have made through email went unanswered. I double checked that I was using the right email addresses with her friend and everything.

Did this lady say what your "friend" had to say about your QH or what her response was?

this is a very sticky situation, and I do not mean to be the bearer of bad news, but you may be playing with fire here. Although you have the registration papers and such, that is all that you have, your friend has the three "C's".....Care,Custody, and Control......I have been in this situation before with people that have put their horses here in my care then run off(I am not saying that is what you have done)She has taken care of the horses, footed their bills and board, or whatever expenses they have incurred for whatever peiod of time that she has had them....you have no contract to clearly define the stimulations of your agreement, so that makes it a he said/she said situation....she can concoct any scenarion she likes, it is a civil matter....if you go onto someones property and remove those horses, even with the papers that you have, it is quite possible that you could find yourself in jail. If the horse were on my property and you did that, you bet you would find yourself in jail. So, be very careful, how you proceed...She can legally take you to civil court and take that horse and get hardship papers from the registry by claiming that you abandoned that horse and have not paid for any of her care, and since you have no written agreement you cannot prove her wrong.

Yes she did tell me what she said about my mare. She doesnt have her. Im not sure but she said that she didnt really understand what "my friend" meant. But possibly the mare was sold or either that she was taken to some other place, supposed to be picked up and "my friend" couldnt reach anyone, etc etc. Something to that extent anyways. In the end it came down to- "my friend" doesnt know where the mare currently is.


Kanoo- you are very right and I am aware of that. I have saved and printed all documentation regarding my mare (you know any conversations that we've had etc) so hopefully that will help.
