That's why you would go to the local authorities, or whoever provided the judgement, and tell them she failed to pay. She then would either have to pay or go to jail.

Tmom, there are ways to collect a judgment, Hubby was in that business to collect for monies owed.
I voted go to TV. Hopefully you have everything you need in writing and photos, and witnesses.
And Judge Alex knows something about horses.
If you get a judgeent in your town it could take a long time to collect, and if she shows no checking account, assets, like cars and such you have no chance collecting.
Keep us posted this sounds interesting.

How pissed off are you is the question? lol A show aired on TV could ruin the career of the breeder altogether. If you feel strong about your case and have no ties to these people then go for it; however, if this incident was truly an accident by the breeder and you don't want to cause waves you may as well just go to court locally and settle. If it was me the determining factor would depened on if she was remorseful and if she took full responsibility for what happened to your horse. If not-TAKE HER TO TVLAND!

Can she (the breeder) choose to not be named in court or on telivision? I am sure that I have seen on some of these shows when one of the parties has chosen to not have thier name or business name released. Therefor if she does choose to remian un-named she may not get a bad name in the industry unless if the same person who saw the show does face to face business with her. Just a thought.

Either way, I sure hope that justice prevails out of all of this and that you get compensated.

I did go to the authorities-all she had was her dogs and those were protected under CA law in 1984. Trust me I tried.

What kind of virus did your mare come back with? Was it a sexually transmitted disease? What happened exactly?

I dont think the breeder will go on TV and ruin her name,do you? She was in the wrong and should have already taken care of this situation..

I just wanted to add when I took a girl over a pony to small claims court I won and seh didnt' pay and didn't pay I contacted the judge and the court sent her a letter threatening contempt..... the very next day(they sent me a copy of the letter) she called and came out and paid me

we would of already taken care of this, dont get me wrong, this has been ongoing and its something that you cannot just point fingers at. nothing to be taken too lightly. we have been going through all information, getting horses tested, getting vet statements and trying to contact the breeder herself. it doesnt just happen over night

the way the lady was telling us that both parties have to agree to go on tv. we have talked it over and decided that if she did say yes we would go. but they are having a hard time getting ahold of her

I think the fact that one of your mares was a maiden mare will really help your case. Have you found any body else that was affected by this?

no we havent heard of anybody else having this problem. this disease is rare in the us, but common overseas. we have contacted 3 vets one being from ohio state and they had to contact vets overseas to get any information on this. plus i think it helps that we had our mares vetted 3 days before they left and she has admitted to not having hers vetted in a couple of years. and that she had seen open sores on her stallion during the breeding. so i have a good feeling but we will see.

This is a crazy thing for you to go through and let me tell you I HOPE YOU WIN!!! I AM on your side.

But.........as far as TV, think about what you have seen on those shows. My first impression is that they will ask you, frankly, if you asked her..."Do you get your stallion checked for STD"s". If you did not ask that question, they might be hard on you. IF I was into breeding and especially if it was a high priced mare, that would be my 1st question AND requirement. Being a single women, If I wanted to become intimate with someone I would require a trip to the clinic for a clean bill of health. I would apply those same requirements for breeding my horse or even my dog as I have seen that STD's can be common in breeding dogs. Your bonus is that the mare was maiden, but did you have THEM checked for STD's prior to breeding. These TV shows can be blunt and down right mean. Maybe that question will never cross their minds, but it is the first thing I thought of.

IMO, If she is putting her stallion up for stud, she should have him checked regularly as well as require clean bills of health on all mares prior to arrival, just to avoid things like this. Seems to me that would be the most responsible thing. Who knows how many other mares where infected by him.

I say "thumbs down" on this one. I would not fly across several states just to get a "tv" cop/judge to say my case......then have to pay a few thousand just to head back home. I suppose he's only covering 1 way tickets??

Plus, We all know who will win this case [you] .


I say take this to your county courthouse and settle the dispute there. If you win ,you get what you wanted- and she gets nothing but a slap on the face and a "pay the plaintiff $xxxxx amount of money" .

one of the reasons we would agree to this is becuase they are paying for airfair roundtrip, dinner money and hotel stay, so really we are not out anything but time.

well, she didnt agree to go to texas so thats out of the ? but we go to court tomorrow so please everybody wish us luck. its hard to tell what will happen. we feel that we have all the facts and figures, pics and doucuments to help support our case but we will see what the judge has to say
